Chile's online betting law: where bill 14.838-03 stands and what remains in force from the Supreme Court ruling

The short answer

As of 22 September 2026, Chile still has no licences for online casinos. The only authorised betting is offered by Polla Chilena de Beneficencia, Lotería de Concepción and Teletrak. The bill that would create licences, Boletín 14.838-03, is before joint Senate committees for the detailed vote and has no urgency. Meanwhile, the Supreme Court ruling that ordered unauthorised platforms to be blocked remains in force. [VERIFICAR]

What remains in force: the Supreme Court ruling

On 30 September 2025 the Supreme Court upheld a constitutional protection claim (recurso de protección) filed by Lotería de Concepción against internet service providers. The ruling declared that platforms offering sports betting or online casino games without authorisation are illegal and ordered ISPs to block access to them. Subtel (Chile's telecoms regulator) then notified a list of 42 sites. [VERIFICAR fecha, número de sitios y alcance]

A year later, the blocking is partial: several operators have reappeared on mirror domains. None of that changes the substance: none of those platforms holds a Chilean licence or is supervised by the Superintendencia de Casinos de Juego (SCJ, Chile's casino regulator), and if one does not pay, there is no Chilean authority to complain to.

The contradiction: blocking them and collecting VAT

In parallel, the Servicio de Impuestos Internos (SII, Chile's tax authority) lets foreign platforms register to declare and pay VAT on their digital services (Resolución 69). Dozens of operators have done so: 39 according to the latest figure we know of. [VERIFICAR] The result is a market blocked by a court and, at the same time, taxed by the treasury. Several senators describe it as de facto regularisation, and it is the main argument of those pushing for the law.

The fact that matters: the Executive has not given it urgency. Without urgency, the bill moves at the committees' pace and can go months without progress. Any date you read in a headline is an estimate, not a timetable.

What the law would do

According to the text approved in general, the bill:

• Creates Chilean licences for online betting operators and puts their supervision in the hands of the SCJ.
• Sets specific taxes for licensed operators. [VERIFICAR tasas del texto vigente]
• Lays down rules on advertising and welcome bonuses that differ from today's; the press already reports that promotions will change when the law comes into force. [VERIFICAR]

• Shuts out of the market any operators that do not obtain a licence.

What the SCJ says about advertising

The SCJ welcomed the ruling and asked ISPs to comply with the block, but has acknowledged that it currently has no powers over online casino advertising: it supervises the land-based casinos it licenses, not foreign sites or those who promote them. What it means for you today

1. No online casino holds a Chilean licence. The ones that accept Chilean players operate under licences from Malta, Curaçao or other jurisdictions; in each review we state which licence each one declares and whether we have verified it.
2. The domain you use may stop working. It is on the block list or may be added to the next one. Before depositing, check the current status on the operator's profile.
3. There is nobody to complain to in Chile. If a withdrawal does not arrive, your only channel is the casino's support and, at best, its foreign regulator. Our methodology measures exactly that: how many hours a real withdrawal takes.
4. Today's bonuses are not tomorrow's. When the law comes into force, the welcome rules will change. Do not choose a casino for a bonus that may disappear.
