Is online casino gambling legal in Chile? What the law says in 2026

The short answer

There is no legal online casino in Chile today. The State does not issue online gambling licences; the only authorised betting is offered by Polla Chilena, Lotería de Concepción and Teletrak, plus the land-based casinos licensed by the SCJ (Superintendencia de Casinos de Juego, Chile's casino regulator). In September 2025 the Supreme Court declared unauthorised online platforms illegal and ordered internet service providers to block them. The online casinos that accept Chilean players operate under licences from Malta, Curaçao or other jurisdictions, with no Chilean licence. Bill 14.838-03, which would change this, is still going through Congress, with no date set.

What happened in 2025: the Supreme Court ruling

On 30 September 2025 the Supreme Court upheld a constitutional protection claim (recurso de protección) filed by Lotería de Concepción and declared that platforms offering sports betting or online casino games without authorisation in Chile are illegal. It ordered internet service providers to block access, and the Subsecretaría de Telecomunicaciones (Subtel, Chile's telecoms regulator) notified a list of dozens of domains to be blocked. What changed in practice:

• The main domains of several operators stopped loading from Chilean connections.
• Many operators responded with alternative domains ("mirrors") or apps that get around the block. That does not make them legal: there is still no Chilean licence.
• The SCJ welcomed the ruling and asked providers to comply, but made clear it has no powers to supervise online gambling or its advertising until the law exists. [VERIFICAR]

Blocking them while collecting their taxes

At the same time as the Court orders blocking, the Servicio de Impuestos Internos (SII, Chile's tax authority) lets foreign platforms register to declare and pay VAT on their services in Chile (Resolución 69), and several dozen have done so. The inconsistency, blocking on one side and collecting tax on the other, is the main argument of those pushing for the law to pass soon.

For you as a player it means something concrete: a casino that "pays VAT in Chile" does not have a licence and offers no guarantee. It is still an operator without authorisation to offer gambling, with its regulator abroad.

Bill 14.838-03

The bill that "regulates the development of online betting platforms" was introduced in March 2022. It was approved in general by the Senate and is now before the joint Economy and Finance committees for the article-by-article vote, with no legislative urgency. [VERIFICAR estado actual]

• Chilean licences for online operators, granted and supervised by the SCJ.

• Formal blocking of operators without a Chilean licence.

What it means for you as a player

1. You have no Chilean regulator to complain to. If a casino does not pay, your complaint goes to the foreign regulator (Malta, Curaçao) or to nobody. The SCJ does not supervise online gambling.
2. The domain can stop working overnight. Subtel's block applies domain by domain; the casino may reappear on another one, or it may not.
3. Your bank may decline charges. Several Chilean banks block card payments to gambling operators.
4. There is no data protection under Chilean law. Your identity documents end up with a foreign company under the rules of its own jurisdiction.
5. The rules are going to change. Once the law passes, the operators you know today may obtain a licence or disappear from the Chilean market.
