Chile's online betting law: what bill 14.838-03 says and what changes for you

The short answer

Chile's online betting law does not exist yet: it is bill Boletín 14.838-03, "Regula el desarrollo de plataformas de apuestas en línea" (regulating the development of online betting platforms), introduced in March 2022, approved in general by the Senate (27 votes in favour and 3 against) and now before the joint Economy and Finance committees for the article-by-article vote, with no legislative urgency. Once passed, it will create Chilean licences supervised by the SCJ (Superintendencia de Casinos de Juego, Chile's casino regulator), specific taxes and rules on bonuses and advertising, and it will shut out operators without a licence. What the bill sets out

The following summarises the known content of the bill under discussion. Because the text changes with each round of amendments, we flag as pending verification anything that depends on the final wording.

Licences and regulator

• The Superintendencia de Casinos de Juego (SCJ) grants and supervises licences to operate online betting platforms (casino, sports betting and other games defined in the law).
• Operators must incorporate in Chile as companies domiciled in the country and meet requirements on capital, the suitability of their owners and certified technical systems. [VERIFICAR requisitos]
• Licences would be for a limited, renewable term, with a public register of authorised operators. [VERIFICAR plazo]

Taxes

• A specific tax on gross gaming revenue (amounts staked minus prizes paid), plus contributions earmarked for public purposes such as sport and gambling-addiction prevention, on top of VAT.

Bonuses, advertising and responsible gambling

• Rules for welcome bonuses and promotions: clearer terms and limits on what can be offered. The press has reported that current terms will change when the law comes into force. [VERIFICAR alcance]
• Regulated advertising, with restrictions on timing, content and sponsorships, and mandatory warnings.
• Responsible gambling: a self-exclusion register, configurable deposit limits, and mandatory age and identity verification before playing.

Blocking unlicensed operators

• Operators without a Chilean licence are prohibited; the law sets up mechanisms for blocking domains and payments and penalties for anyone who operates, or helps others operate, without a licence.
• Advertising for unlicensed operators is prohibited, which extends to media, public figures and sites like this one. That is why this site is built for that scenario: every operator profile has a Chilean licence field, which today is set to "no" for all of them.

Two tips for the transition:

1. Do not leave large balances with any operator. A casino that decides not to apply for a Chilean licence may cut off Chilean players at short notice; withdrawing early is easier than complaining later.
2. Keep your records. Deposits, withdrawals and screenshots of your account. If the operator obtains a Chilean licence, your history carries over; if not, it is your evidence for any complaint.

How we got here

• Ley 19.995 (2005), Chile's casino law, regulates land-based casinos under the SCJ; it does not cover online gambling. Licensed land-based casinos are listed in the land-based casinos guide.
• 2022: the government introduces bill 14.838-03 to regulate online platforms, which until then operated in a vacuum that the SCJ and Polla Chilena considered illegal.
• 2025: the Supreme Court, ruling on a constitutional protection claim by Lotería de Concepción, declares unauthorised platforms illegal and orders them blocked. In parallel, the SII (Chile's tax authority) lets foreign platforms register to pay VAT (Resolución 69). Details in Is online casino gambling legal in Chile?.
• 2026: the Senate approves the bill in general and opens the deadline for amendments; the debate centres on taxes, bonuses, advertising and the role of Polla and Lotería.

What we will do when the law passes

This site will rewrite its homepage, reviews and guides on the same day the law is published:

• Each operator will show whether it holds a Chilean licence, its number and a link to the SCJ register.
• Operators without a Chilean licence will no longer appear in the ranking.
• The bonus guides will be rewritten under the legal rules.
• We will publish a "what changes with the new law" guide in news and record every change in the history of the page affected.
